1) Read the following fact pattern. Assume the role of
consultant and prepare a brief essay, two paragraphs, for your client that
suggests the appropriate business structure for his needs. In doing so, fully
explain your reasoning and spell out the pros and cons of the suggested
structure. If there is additional information you would need from the
entrepreneur, indicate the questions you would ask him.
Green is a talented artist and he creates landscape
paintings while working in the open air. Green originally started selling his
works at flea markets and small craft fairs. The popular response encouraged
him to create a website and start a mail-order business. He outsources some of
the printing responsibilities, and hired someone part time to help him ship out
his work to website-based customers. He does not currently own permanent retail
space, but he has not ruled it out. What business structures would you
recommend to Green? Advise Green of the pros and cons of each structure.
2) Read the following fact pattern. Provide an answer within
two paragraphs or more discussing your ruling as Judge in the case.
Bob’s neighbor Dave is good friends with Bob and cares for
Bob who is old, sick and dying. Dave takes Bob to the grocery store, to the
barber, run errands for Bob, and pays all his bills since Bob is bed ridden and
has a difficult time getting around. Dave maintains that Bob had promised him
his two gold rings worth ten thousand dollars each upon his death. However,
when Bob eventually died, his son took his rings as part of Bob’s estate. Dave
claims the rings were promised to him and asks you as Judge to rule on his
claim. How do you rule?
