Instructions: Students are encouraged to discuss the topics with one another and with me, but each student must organize and write on an individual basis.   Please answer the specifics of each question and do not leave parts out.   The quality of reasoning and the quality of argument are essential to demonstrating proficiency.   You must answer both questions. Please write using APA formatting and you will be asked to write in memo format.   Whenever possible use information from the text to support your perspective.   Most of the information you need to answer the questions are related to what you just studied in module 2.  Make a decision on what side of the argument your going to choose and then back it up with information from the text.  There are multiple ways you can answer these questions, but the goal is for you to apply some of your knowledge to the cases.  The average length of response is at least a page per question.

You are an operational manager for the medical imaging department of a small hospital. A 35 year old African-American employee with a past history of alcoholism requested to be put on day shift’s only, with no call rotations so she could attend certain sobriety support activities. When her request was denied she voiced complaints that this violated the Americans with Disabilities Act, and was fired a few weeks later by the ultrasound supervisor for unspecified performance problems. The human resources department has asked you, the operational manager, if you think the woman has grounds for a lawsuit.
Write a memorandum, which identifies any and all laws under which this employee may have grounds for legal action, explaining how her treatment could be interpreted as illegal in each case. Identify any additional information, which could more clearly establish whether an illegal action had occurred.
